All my childhood, I remember her talking and reminiscing about the place she came from

She spoke in a sweet nostalgic manner:

The spear at the holidays, theו family gatherings, our lovely neighbors, the park near our home,

However, despite her deep sorrow, she felt blessed that she was able to move to a new land. 

 

Growing up in the shadow of an immigrant grandmother allowed me to understand the perpetual conflict.

A conflict that is known to every immigrant,  

Between the dream of giving your family a better future and the fears of leaving your life and the home, you grew up in. 

 

My Grandmother let me understand how significant the immigration transition was and just how in-depth the whole procedure was,

It was a life-changing decision, a new language, new laws, a new home, new schools, a whole new way of life. 

Taking care of children and the family but knowing at the same time the opportunities you were giving them for a better future, freedom, and success.

 

Flavors, dishes, and memories can be taken with you anywhere 

but better opportunities, your and your family’s well-being, peace, and freedom –  sadly, you cannot always find in some countries.

H-1B Visa Persons in a Specialty Occupation

The H-1B Visa allows U.S. companies with a Federal Identification Number/IRS tax number to employ a foreign professional to work in a specialty occupation for up to six years. Examples of specialty occupations include accountant, computer analyst, engineer, financial analyst, scientist, or architect.

H1B Visa Eligibility – It Is Suitable For:

  • Foreign professionals in specialty occupations, such as scientists, engineers, programmers, research analysts, management consultants, journalists, accountants, and others with a Bachelor’s or equivalent degree
  • Foreign nationals entering the U.S. to offer exceptional services relating to cooperative research and development projects administered by the U.S. Department of Defense
  • Professional Nurses entering the U.S. to perform complex job duties or supervise nursing operations
  • Distinguished fashion models
  • U.S. companies to bring in qualified foreign professionals for jobs that require a bachelor’s degree and specialized skills

H1B Visa Benefits

  • You do not have to maintain a foreign residence and show intent to return to your home country while applying for the visa.
  • Your dependents can stay with you as long as you maintain your H1B status. They can also attend school.
  • You can freely travel in and out of the U.S. by proving that you have a valid visa.

H1B Visa Requirements

A. Criteria For Determining Employer’s Eligibility

To be eligible for sponsoring an H1B visa, the employer must prove that:

  • The position offered requires knowledge, both theoretical and applied, which is obtained through studies at an institution of higher education
  • The position requires a specific course of study which relates directly to the position
  • Attainment of a bachelor’s or higher degree in the specific activity (or its equivalent) is a minimum requirement for the position
  • B. Criteria For Determining Employee’s Eligibility

To be eligible for an H1B visa, you must demonstrate that you have:

  • Full state licensure to practice in the occupation, if such licensure is required to practice in the occupation
  • Completed the degree required for the occupation or possess experience in the specialty equivalent to the completion of such degree
  • Recognition of expertise in the specialty through progressively responsible positions relating to the specialty
  • C. Positions Generally Considered Professional
  • Accountant, Acupuncturist, Chiropractor, Computer Programmer, Dietitian, Electronics Specialist, Fashion Designer, General Manager (where business is complex), Graphic Designer, Hotel Management, Industrial Designer (with B.A.), Interior Designer (commercial), Journalist, Librarian, Medical Records Librarian, Medical Technologist, Minister, Orthopedist, Pharmacist, Social Worker, Technical Publications Writer, and Vocational Counselor.

Client story

I am a software engineer working for an Indian company in Mumbai.

We also have an office in the US. Our US office filed an H-1B for me last year, which was approved by the USCIS.
I have an H-1B Visa stamped in my passport, but I have never used it to enter or work in the US.
I am getting married soon and my fiancé works in the US on H-1B. After the wedding, I want to travel and work in the US but there is some uncertainty on whether my company will send me to the US on H-1B or not.
If my current company does not offer me a position in the US, can I take up employment with some other company when I am in the US on H-4 Visa?
If another company offers to file a new H-1B for me, will I be subject to the quota again?

Our solution

The spouse and unmarried children under 21 years of age of an H-1B employee may seek admission as dependents in the H-4 Visa category. However, family members in H-4 status may not engage in employment in the United States. Hence, you will not be able to take up employment in the U.S. while in H-4 status. If, however, the petitioner who filed the original H-1B petition on your behalf decides to employ you before you leave India, you may seek admission in the U.S. on your H-1B Visa (you may be asked to show appropriate documentation evidencing the offer of your H-1B petitioner when entering the US).
Since you have already been counted against the quota last year, you are not subject to the quota for at least 6 years. This means that if the petitioner chooses to employ you after your entry in the US on the H-4 Visa, you can commence employment once the petitioner has sought to change your status from H-4 to H-1B by filing and obtaining approval of a new H-1B petition Alternatively, if after you have entered the U.S. on the H-4 Visa, you are offered employment by a new employer, you can seek to change your status from H-4 to H-1B based on an H-1B petition from this new employer.
This can be done at any time because you are not subject to the quota. However, you will not be able to take up employment with them until the H-1B petition is approved.

My H-1B visa registration was not selected this year - now what?

H1B visa has an annual quota. And it’s running like a lottery. What happens if you do not win the lottery? Here are some options that will allow you to proceed with the visa application process. 

The main ways are to find a temporary replacement until next year's raffle or find a similar visa
that will help you achieve the same goal.

  • Those who graduate in the United States are eligible for an additional 12 months of visa extension or transition to an internship and internship visa In a field related to the area in which he studied. So if you have not won an H1B visa this year, you can try to “go back” to the previous visa and extend it or get a study visa that allows you to work and teach together.
  • Another option is an Internship visa that will allow you to work in the field you studied.
  • Another creative way is a consulting and training visa. The company that wanted to employ you based on an H1B visa can “invite you to the United States based on professional as an expert in the field to train and guide its employees.
  • Another option is an E2 visa, which allows you to enter the US as a freelancer or business owner.
  • Another attractive option is an O1 visa – also called individuals with Extraordinary Ability or Achievement. Suitable for any person with special skills or significant achievements in his field.
  • And there are also special visas for applicants with citizenship from Chile, Mexico, Singapore, and Canada that are worth checking out as a replacement if you are from those countries.

what is important is not to give up after the first attempt to obtain a visa.
